Before your time on the water, we ask all guests to review and sign a liability waiver. This page is provided so you can read through that waiver in advance at your own pace so you can focus on enjoying the experience.
KAYAK, CANOE & PADDLEBOARD RENTAL AGREEMENT, LIABILITY WAIVER, AND ASSUMPTION OF RISK
PLEASE READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS
1. Parties
This agreement is entered into between River Canyon Kayaks, LLC, with a legal address of 706 Walnut St, Chattanooga, TN 37402, and the undersigned participant (“Renter”). Rental operations and equipment are located at 21752 River Canyon Rd., Chattanooga, TN 37405.
2. Acknowledgment of Risk
Renter understands that kayaking, canoeing, and paddleboarding on the Tennessee River involve inherent risks. This is a navigable waterway with active boat traffic and unpredictable conditions. Risks include, but are not limited to:
* Drowning and water-related injuries.
* Strong currents, wakes, changing water levels, and boat traffic.
* Collisions with objects, vessels, or other individuals.
* Weather-related hazards, equipment failure, and physical exhaustion.
3. Self-Guided Rental & Responsibility
This is a self-guided rental. River Canyon Kayaks, LLC:
* Does not provide guides or supervision.
* Does not offer rescue or pickup services for stranded renters.
Renter agrees to:
* Follow recommended routes and remain within approximately 20 feet of the shoreline.
* Travel upriver and return to the launch location at 21752 River Canyon Rd within the rental period.
4. Participant Requirements Minimum Age: 12 years old. Minors may paddle solo only under adult supervision.
Safety: A properly fitted U.S. Coast Guard-approved personal flotation device (PFD) must always be worn.
Sobriety: Participation under the influence of drugs or alcohol is strictly prohibited.
5. Equipment Responsibility (“You Break It, You Buy It”)
Renter accepts full responsibility for all rented equipment. Renter authorizes River Canyon Kayak Rentals, LLC to charge the card on file for damages or loss as follows:
Kayak, Canoe, or Paddleboard: $750.
Paddle: $200.
PFD: $100.
6. Rental Period & Late Returns
The standard rental period is approximately 2 hours. Late returns will incur a $40 late fee, plus additional hourly rental charges.
7. Release of Liability & Indemnification
To the fullest extent permitted by Tennessee law, Renter releases and discharges River Canyon Kayaks, LLC, its owners, and affiliates from all liability for injury, death, or damage, including claims of negligence. Renter agrees to indemnify the LLC against any claims or expenses (including attorney fees) arising from their participation or misuse of equipment.
8. Governing Law
The laws of the State of Tennessee shall govern this agreement.

Acknowledgment & Signature
